Section 44 and IR35 Contract Reviews
The contracts that you have in place with your subcontractors are extremely important. These set out the terms and conditions of their engagement, and poor contractual terms will mean subcontractors cannot be paid gross. Moreover, if you have contracts in place with your clients, these will also affect whether your subcontractors can be paid gross. These terms need to be considered on a ‘roots and branches’ basis, making sure that genuine self-employment is not precluded by terms anywhere in the contractual chain.
We can review your contracts for you, amending the terms to allow for self-employment. If you don’t have appropriate documentation, we can draft it for you.
