As you will undoubtedly know, a robust set of terms that accurately reflect the working practices of the assignment are your first line of defence.

We will assess the contract for its suitability and provide recommendations should there be a requirement to do so. We will also consider your day-to-day working arrangements to ensure that they support an ‘outside of IR35’ status and do not leave you vulnerable.

A contract review is by no means a guarantee that HMRC would deem you to be outside of IR35,. However, it does provide you with peace of mind that you have a solid foundation for your defence in the event of an enquiry, and demonstrates that you have taken reasonable care in assessing your position.

If you find yourself within the scope of the new rules, an IR35 contract review may help to demonstrate to a client that they should be treating your engagement as being outside of IR35.
