Split Contracts/Office Holders

With HMRC having successfully challenged split contract arrangements in the past – in which an individual provides consultancy services to a company of which they are a director – it is imperative that there is documentation in place which clearly sets out the different relationships.  It is also imperative that the day-to-day operation follows the terms laid down between the parties, otherwise you face having to pay tax and NIC on all income received from the engagement.

We will advise on whether the split contract is viable given the circumstances, provide contracts to support the arrangement, and advise on the day-to-day operation.
